1. Accepting these terms

These Terms of Use are an agreement between you and Gully System Private Limited (“we”, “us”), Bengaluru, India. By creating an account or using GullyContacts you accept them. If you do not accept them, please do not use the service.

If you are using GullyContacts on behalf of an organisation, you confirm you are authorised to bind that organisation to these terms.

2. What the service is

GullyContacts is a contact management application available on the web and as mobile and desktop applications. It lets you record, search, tag, import and export contact information.

Your contact records are stored on the device you use them on, not on our servers. We hold an account record so you can sign in. Please read the Privacy Policy, which forms part of these terms.

3. Your account

• Give a real email address you control, and keep it current — it is how we verify your identity and let you reset your password.
• Keep your password confidential. Activity under your account is your responsibility.
• Tell us promptly if you believe someone else has accessed your account.
• Do not share an account between people, or create accounts by automated means.

4. Your data and other people’s data

An address book is unusual: most of what it holds is personal data about other people. That carries obligations, and they are yours.

• You keep all rights in the contact data you create or import. We claim no ownership of it.
• You confirm you are entitled to hold and use the contact information you put into GullyContacts, and that doing so complies with the laws that apply to you.
• If you use the data for marketing or outreach, complying with the applicable consent and anti-spam rules is your responsibility, not ours.
• Because your contacts live on your device, keeping backups is your responsibility. Use the export feature. We hold no copy and cannot restore data you lose.

5. Acceptable use

Do not use GullyContacts to:

• break the law, or infringe anyone’s rights including privacy rights;
• store or distribute unlawful, harassing or deceptive content;
• send unsolicited bulk messages, or build lists for that purpose in breach of applicable law;
• attempt to gain unauthorised access to the service, other accounts, or our infrastructure;
• probe, scan or load-test the service without our written permission, or interfere with its normal operation;
• reverse engineer or resell the service except to the extent the law expressly permits.

6. Availability and changes

We aim to keep GullyContacts available and working, but we do not guarantee uninterrupted service. We may change, suspend or discontinue features, and we may perform maintenance that makes the service temporarily unavailable.

If we discontinue the service entirely, we will give reasonable notice so you can export your data.

7. Intellectual property

The GullyContacts software, design, name and logo belong to Gully System Private Limited. These terms grant you a limited, non-exclusive, non-transferable, revocable right to use the service. Nothing here transfers ownership to you.

8. No warranty

The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the service will be error free, or that data stored on your device will not be lost.

9. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill or data, arising from your use of or inability to use the service.

Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the service in the twelve months before the claim, or one thousand Indian rupees (₹1,000).

Nothing in these terms limits liability for fraud, or for anything else that cannot be limited under applicable law.

10. Suspension and termination

You may stop using GullyContacts at any time and ask us to delete your account.

We may suspend or terminate an account that breaches these terms, that we reasonably believe is being used unlawfully, or where required by law. Where it is practical and lawful to do so, we will tell you why.

Your contacts remain on your device after termination; removing them is done by clearing the app’s data or uninstalling it.

11. Governing law

These terms are governed by the laws of India. The courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or in connection with them.
